WHAT DOES THE LIMITED WARRANTY COVER

This five (5) year limited warranty covers the Hefty® MAX PRO™ 12-gal Storage Tote, Product Number 7169 (“Product”). This warranty covers the physical goods for any defects in the material or workmanship when used for normal household use as further detailed below.

HOW LONG DOES THE WARRANTY LAST

The term of this warranty begins on the purchase date of the Product from an authorized retailer by the original purchaser and continues for 5 years of ownership of the Product, subject to limitations and exceptions.

WHAT WILL HMS MFG. CO. DO UNDER THE FIVE (5) YEAR LIMITED WARRANTY

If the Product falls within the guidelines of this warranty as determined by HMS Mfg. Co. and there is a defect, malfunction, or other failure of the Product not caused by any misuse or damage to the Product while in the customer's possession, we will take steps to remedy the failure or defect at its sole discretion.

WHAT ARE THE WARRANTY'S EXCLUSIONS AND LIMITATIONS

This warranty does not cover damage caused by misuse, abuse, and/or accident such as, including but not limited:

·       Commercial/Industrial use of a product

·       Normal Wear and Tear

·       Repairs

·       Unauthorized modification of the product

·       Theft or loss

·       Damage caused from misuse

·       Accidental/Intentional Damage

·       Negligence

·       Damage caused by a natural disaster

·       Tampering

DO NOT ATTEMPT TO REPAIR THE PRODUCT.

AND REYNOLDS CONSUMER PRODUCTS MAKE NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCTS, INCLUDING ANY WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE.

LIMITATION OF LIABILITY

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
